Motiontribe privacy and cookies policy

1. Who we are and how to contact us

This Privacy Policy is an agreement between Motiontribe S.A. (referred here as "Motiontribe", "Us", "Our" or "We"), and the User. Our address is Quai Paul Verlaine 2, 6000 Charleroi Belgium. For the porpuse of the GDPR we are the controller of your data.

Motiontribe is an online platform that connects gear owner and gear renters. We allow our members to add their gear online and to rent it to other members of the community. Through our partner AXA, we offer an insurance and a way to pay online through Stripe. We verify all our members to make sure they are who they say they are and to have a proof that they belong to the audio-visual industry. Our goal is to build a safe community.

2. Applicable law

Motiontribe is committed to protect and respect the privacy collected on our Site. We treat your data in line with the General Data Protection Regulation (GDPR) as implemented in Belgian law by :

  • the Belgian law of 8 December 1992 (the "privacy law") amended by the law of 11 December 1998 and in force since 1 September 2001.
  • European directive No 95/46/CE of 24 October 1995 on privacy protection.

3. Information collected

There are many occasions when you provide information that may enable us to identify you personally ("Personal Data") while using the Services. The Personal Data we may collect from you is outlined in the list below.

  • Your first name and last name
  • Your address
  • Your phone number
  • Your email address
  • Links to your professional page or website or videos/photos you have done before
  • Your date of birth
  • Your gender
  • Your IP address
  • Your bank account and payment information
  • Your VAT and business information (when using our Website as a business)
  • Your ID front and back

We also collect some non personal information such as:

  • The name, version and location of the browser you use to visit our Website
  • The operation system and type of device you use
  • The service provider you use to access the internet

4. Use of your personal data

Motiontribe uses Personal Data we collect to allow you to access and use our Services and Site, to analyze how the Services are used and to help you efficiently access your account, to provide the Services, personalize content, diagnose problems, maintain security and monitor aggregate metrics. We also use your data to operate and improve the Services and Site, to create and maintain a safe environment on the Services and Site.

We also use your personal data to :

  • Send you messages (support, administrative, security alerts)
  • Send marketing, advertising and other information that me be of interest to you
  • Create and send referral programs, surveys, contest and other promotional activities sponsored or managed by Us or by our third party business partners.
  • We may, directly or trough third parties, analyse and review the messages you exchange with other users for fraud prevention or risk assessment.

5. Who do we share your personal data with

As we consider it to be a vital part of our relationship with you, we may share your personal data with third parties such as service providers, advisers, API(such as Veriff) and advertisers.

If you request that we remove your Personal Data as described in this privacy Policy, we will also sent that request to any third-party with whom we have shared your data. We are not, however, responsible for removing your Personal Data obtained by any third party.

6. Change, delete your information’s and fill in a complaint

At any time, you may correct, review, update, or delete the Personal Information in your Motiontribe Account by logging into your Account. Please also note that any reviews and similar materials posted by you may continue to be publicly available on the Site in association with your first name, even after your Motiontribe Account is cancelled.

You may also ask us for a copy of your data, we would reply to you within 40 days.

If Motiontribe is involved in any acquisition, merger, sales of assets or bankruptcy, then we may sell, transfer or share some of our assets, including your personal information’s without your consent.

7. Secure your personal info

We maintain reasonable security standards, both physically and electronically, including encryption and passwords. We have physical security measures and procedures to protect the security and privacy of your Personal Data. Only a limited number of Motiontribe employees and partners are allowed to access, delete, and modify your data. We will make reasonable efforts to ensure that your privacy interests are protected.

8. Storage Period

Unless you request that we remove your Personal Data, we will keep it as long as your account is active, or it is reasonably needed, unless a longer retention period is required by law. We may keep your Personal Data after your account has been deactivated for the period of time needed for us to comply with legal obligations or to pursue legitimate business interests.

There may be links to other websites on Site. Since we are not responsible for the content on those websites nor about their privacy policy and data protection rules, we advise you to always read carefully the privacy policies of those websites.

The "Last Updated" date at the top of this Privacy Policy will be adapted to reflect those changes.

It's important that you review the changed Privacy Policy. If you do not wish to agree to the changed Privacy Policy, then we will not be able to continue providing the Services and Site to you.
